Data breach
A data breach occurs when personal data is disclosed, altered, deleted, or processed unlawfully without authorization, thereby potentially infringing on the rights and freedoms of the individuals concerned.
Examples of data breaches
- Loss or theft of a laptop containing unencrypted customer data
- Sending an email containing personal data to the wrong recipient
- Hacker attack on a database
- Disclosure of sensitive health data due to misconfiguration of a cloud
- Manipulation or unauthorized alteration of data in a CRM system
Reporting obligation under the GDPR
According to Art. 33 GDPR, a data breach must be reported to the competent supervisory authority within 72 hours if there is a risk to the rights and freedoms of natural persons.
In some cases, notification of the persons concerned (Article 34 GDPR) is also required.
Violations of the GDPR can result in heavy fines. In addition, there may be claims for damages from those affected and considerable damage to reputation.
