Jurisdiction for Legal Actions Against the Insurer
Legal actions against the insurer arising from the insurance contract can be brought before the local court responsible for the insurer or for the headquarters of the branch office administering the contract.
If the contract was concluded online, the court of the place where exali.com has its headquarters (Augsburg, Bavaria) is also responsible for legal actions that are brought against the insurer from the insurance contract.
The court in whose district you were domiciled at the time of the commencement of the legal action or, in the absence of such, your usual place of residence, has local jurisdiction for legal actions arising from the insurance contract or insurance brokerage.
Legal actions against the insurer from indemnity insurance can also be brought before the court of the place where the damaging event occurred.
Supervisory authority: Complaints can be directed to the insurer and the Federal Financial Supervisory Authority (BaFin, Sektor Versicherungsaufsicht, Graurheindorfer Str. 108, 53117 Bonn) or the Dutch Authority for the Financial Markets (AFM, Vijzelgracht 50, 1017 HS Amsterdam, The Netherlands).
