Unauthorised Use of Music at Halloween Event

After the Halloween Party: Lawsuits and Costs

Party Start With Complications

The planning is complete, the big day has arrived - Halloween. Michael has chosen an old barn as the location. The purchased and self installed decorations are impressive: Pumpkin lanterns cut creepy grimaces, garlands decorate the room and a fog machine creates a mystical, spooky atmosphere. A sound machine accompanies the whole thing with the right background noise.

The arriving guests are accordingly impressed: Jason Vorhees wants to take a close look at the ambience. However, as his field of vision is restricted by his mask, he overlooks a garland and gets thoroughly entangled. In an attempt to free himself with his machete, he chops around a little too wildly. Unfortunately, he not only hits the garland, but also cuts an inadequately secured cable. This cable is supposed to hold a chandelier with candles in place. After Jason's machete hit, the construction hurtles downwards and hits Freddy Krueger, who was trying to help his colleague. The shock runs deep at first. But with a little effort and Pennywise's threat to drag everyone involved into the sewers, the unpleasant situation is resolved. Freddy is taken to the nearest emergency room and the party can continue.

Loose Screw: Frankenstein's Monster Falls Apart At the Buffet

Of course, those present don't let a little thing like that ruining the best night of the year. After a good meal, the world looks completely different again. So the first thing everyone does is tuck into the buffet. Michael has hired a caterer as a subcontractor for this. Of course, he also checked vegan options and possible intolerances in advance. But despite all the precautions, something goes wrong:  Frankenstein's monster has a healthy appetite. But after a few plates of supposedly low-sodium snacks, his screws corrode. To the horror of those present, the monster literally disintegrates into its individual parts. Leatherface uses his anatomical expertise to patch up the disintegrating monster in a makeshift manner, but soon has to admit to himself: The only thing that can help here is a call to the manufacturer. A short time later, an enraged Viktor Frankenstein collects his monster to reassemble it in his workshop.

Unauthorised Use of Music at Halloween Event

There's only one thing left to save the mood: hit the dance floor! The playlist features plenty of classics. This includes a remix of a well-known piano piece by John Carpenter. For Michael Myers in particular, this music is associated with many precious memories, so he films the dancing crowd with his smartphone and then shares the recording on social media. Despite a few obstacles, everyone involved still has a great evening and Michael can look back on a successfully completed project.

Holidays can be challenging. This also applies to Christmas - as this damage event shows: Christmas With Obstacles: When Santa Claus Messes Up At Work.

After the Halloween Party: Lawsuits and Costs

A few weeks after the party Michael receives some unpleasant mail. The owner of the party equipment doesn't want to simply accept the broken garland and demands the costs back. At the same time, Freddy Krueger also asserts his claims. After being injured by the falling chandelier, he is unable to haunt the dreams of his fellow human beings for some time - Michael has to pay for this loss of earnings and the medical bills.

The caterer's supposedly negligence also has consequences: Viktor Frankenstein claims compensation for the damage to his monster. He is also demanding compensation for the extra hours of work he had to spend reassembling his monster.

As one misfortune is not enough, the pile of bad news also includes a written warning from film composer John Carpenter. He is furious that his music was used at the party without permission and then also distributed on social media. As he considers this to have been an industry event, he is demanding fees and compensation for the unauthorised use of his work.

Professional Indemnity Insurance Protects Against Horror in Business

Fortunately, Michael has made provisions for such scenarios. His Professional Indemnity Insurance covers both the property damage caused by the broken garland and the personal injury suffered by Freddy Krueger. Infringements such as the unauthorised use of music are a ‘classic’ form of professional negligence. Here, too, the insurer covers the justified claims of third parties.

However, whether the literal disintegration of Frankenstein's monster can actually be blamed on the caterer is another matter. In this case, the insurer must examine the claims made and, if necessary, defend against unjustified claims.

Despite a few failures, Michael can still devote himself to his work with a clear conscience - without the fear of written warnings, claims for compensation and financial worries.
